The business rescue practitioners (BPRs) of Optimum Coal Mine (OCM) have launched a daring bid to wrestle control of R3.4 billion worth of the mine's preserved assets from a curator appointed by the courts.
In March, the North Gauteng High Court in Pretoria issued a preservation order – the biggest in the National Prosecuting Authority's (NPA) history – for the Gupta family's Tegeta's shares in the mine, its day-to-day operations, and Optimum Coal Terminal (OCT).
The order also made provisions for the appointment of a curator to care for the assets pending the start and finalisation of asset forfeiture proceedings.
