Ahmore Burger-Smidt, director of data protection and cybercrime at law firm Werksmans, says there is a gap in the Popi Act.

“The definitions in the legislation say you may not receive direct marketing messages by way of mail or electronic communication. But phone calls are not mentioned at all. The act does not mean you will never hear from a call centre agent again unless the law changes,” says Burger-Smidt.
