Iqbal Survé has told the Constitutional Court that Nedbank's closure of his Sekunjalo group's accounts will put 44 of his companies out of business and prevent them from making BEE "donations" – and he's going after an Appeal Court judge to stop that from happening.
In a supplementary affidavit filed at the apex court, Survé has accused Judge Trevor Gorven, one of the five Supreme Court of Appeal (SCA) judges who found there was no prima facie evidence that Nedbank's decision to close Sekunjalo's accounts was racist, of being "conflicted". That alleged conflict is centred on Gorven's founding role in an environmental charity that previously received donations from Nedbank-linked entities.
Survé says he intends to file a complaint against Gorven, in relation to this alleged conflict, at the Judicial Service Commission (JSC).
