The ANC will appeal the Durban High Court ruling, which found the ANC and uMkhonto weSizwe (MK) Party's logos were different and would not create confusion on voting day.
The copyright infringement application, brought by the ANC, was dismissed with costs on Monday.
ANC secretary-general Fikile Mbalula, in an affidavit submitted to the court, said there was "overwhelming public interest" in ensuring that, when voters approached voting booths, they "are not confused" by the MK logo, which is the ANC's defunct military wing's brand.
